About the event

The SFE Devon & Cornwall Committee are delighted to welcome Holly Mieville-Hawkins from Michelmores LLP and Patricia Wass from Enable Law. Holly will be looking at the removal of deputies and Patricia will be looking at Undue Influence & the Elderly Client. This will be Patricia's final session with SFE Devon & Cornwall and will also spend some time talking to us about how the law in this area has changed during her career. 

The Teams link will start promptly at 2pm, finishing at approximately 5.15pm, with a 15 minute comfort break.

Speakers:

Holly Mieville Hawkins
Holly will be providing us with a detailed look at best practice and the law in respect of attorney and deputy removal.
 
Holly is a Senior Associate Solicitor and Head of the Mental Capacity Group at Michelmores LLP. She has extensive experience acting for and advising deputies and attorneys, making and defending applications in the Court of Protection, and regularly acts where there are concerns of financial abuse. She is very experienced at dealing with statutory will, incapable trustee and gifting matters. She is a member of the Law Society Wills and Equity Committee, a fully accredited member of Solicitors for the Elderly, a committee member for South West COPPA, and works closely with the OPG as a stakeholder. She has written for PS Magazine, Elder Law Journal and STEP magazine. She has been recognised for a number of years as an 'Associate to Watch' by the Chambers UK legal directory. Chambers UK states: she is an "exceptionally good" lawyer, recognising that "she has been involved in drafting guidance for this area and makes a significant contribution to the profession".

Patricia Wass
Patricia will be taking to us about undue influence and the elderly client covering topics including:
How do we define vulnerability
Professional Conduct issues
Principles of Undue Influence
Proving Undue Influence
Possible indicators of elder abuse, undue influence and incapacity
Case law update
 
Patricia has over 37 years' experience working as a Solicitor dealing with all aspects of private client law and is a consultant in the mental capacity team at Enable Law (part of the Foot Anstey Group) specialising in Powers of Attorney, Court of Protection work and legal issues relating to the elderly and vulnerable.
She has acted as a Panel Deputy for the Office of the Public Guardian. She lectures regularly on her practice area for various legal training providers and contributes articles to legal journals. Patricia is a Past Worldwide Chair of STEP and served on STEP Council and Board. She has recently received the Lifetime Achievement Award 2021 from STEP.
